We may update these terms from time to time. Changes take effect when posted. The terms in effect when you book apply to that booking.
Changes to these terms
These terms are governed by the laws of the State of North Carolina. Any dispute will be brought in the state or federal courts located in Wake County, North Carolina.
Governing law
You agree to indemnify and hold us harmless from claims arising from your use of the media beyond the license granted, your violation of these terms, or a lack of authority to authorize photography of the property.
Indemnification
- The website is provided "as is," without warranties of any kind.
- We do not guarantee that a property will sell, sell at a particular price, or sell within a particular time.
- To the fullest extent the law allows, our total liability for any claim related to the website or our services is limited to the amount you paid for the service at issue.
- We are not liable for indirect, incidental, or consequential damages, including lost profits or lost sales.
Disclaimers and limitation of liability
- The price shown at the time of booking applies to that booking.
- Payment is due in full upfront, at the time of booking.
- Travel is included for properties in Cary, Apex, Morrisville, Raleigh, RTP, Garner, Holly Springs, and New Hill. Properties outside these areas, up to 10 miles away, are subject to a $25 trip fee. We do not currently serve properties farther than that.
Pricing and payment
- Appointments are booked through our online scheduler. A booking is confirmed when you receive a confirmation from us.
- You are responsible for giving us accurate property details and access instructions.
- By booking, you confirm that you have the property owner's permission for us to enter and photograph the property.
- The property should be photo-ready at the scheduled time. We photograph the property as presented. Cleaning, staging, and moving furniture are not included.
Booking and scheduling
- All content on the website, including photos, video, text, and logos, belongs to us or our licensors. You may not copy, download, or reuse it without written permission.
- You agree not to misuse the website, interfere with its operation, or use it for any unlawful purpose.
- Service descriptions and prices on the website may change at any time.
Use of the website
These terms govern your use of lightwellhaus.com and the photography services provided by Lightwell Haus ("we," "us," or "our"). By using the website or booking a service, you agree to these terms.
Effective date: October 5, 2026
- Cancellations must be made at least 24 hours before the scheduled shoot. With that notice, there is no charge.
- Cancellations with less notice are subject to a $50 fee, and the rest of your payment is refunded. You can avoid the fee by rescheduling instead of cancelling, up to two times per booking. After that, the $50 fee applies to each reschedule made with less than 24 hours' notice.
- If we arrive and cannot access the property, or the property is not ready to photograph, the session will be rescheduled. This counts as one of the two free reschedules per booking.
- Exterior work affected by weather will be rescheduled at no charge.
- We may reschedule because of illness, emergency, or unsafe conditions and will give as much notice as we can.
Cancellations and rescheduling
- Photos are delivered within 48 hours of the session, and video within 72 hours. Turnaround times are estimates, not guarantees.
- Standard editing is included. Reasonable revision requests made within 7 days of delivery will be handled at no charge. Additional editing may be billed separately.
- Delivered media is available for download for three months. We keep it in our archive for one year. Please save your own copies.
Delivery and revisions
- We retain the copyright in all photos, video, and other media we create.
- Once payment is received in full, you receive a non-exclusive, non-transferable license to use the media to market the photographed property for the life of that listing.
- The license covers the MLS, listing websites, social media, print materials, and your own marketing of that listing.
- You may not sell, sublicense, or give the media to third parties, such as other agents, builders, stagers, or designers, without our written permission. Third-party licenses are available on request.
- No license is granted until payment is received in full.
- We may use the media in our portfolio, website, social media, and marketing. If you need a property kept private, tell us in writing before the session.
Image ownership and license
- You are responsible for arranging lawful access to the property and for making sure pets are secured.
- We take reasonable care while on site. We are not responsible for pre-existing damage or conditions at the property.
- We may decline or end a session if conditions are unsafe.
Property access and safety
